OLD LYME PLANNING COMMISSION
REGULAR MEETING
MAY 12, 2011


PRESENT WERE:  Harold Thompson, Robert McCarthy, Steve Ross, Stephen Martino and Alternates Don Willis and Todd Machnik.


SUBDIVISION – RICHARD AND DONNA BATTALINO – 160 MILE CREEK ROAD

Thompson noted that the applicant’s engineer, Tony Hendriks met with Mr. Metcalf on Wednesday morning to go over some of the outstanding items that still need to be addressed.  Thompson also noted that the commission received a letter from Carol Van Patten with regard to the proposed subdivision.  He also noted that this information was forwarded to Attorney Cassella for his review.    

Groves also noted that the commission had received correspondence from Attorney Cassella which outlines items to be addressed as well the conditions issued as part of the Inland Wetlands approval with regard to the common driveway.

Hendriks noted as a result of his meeting with Metcalf he submitted revised plans and addressed some of the issues discussed.   He stated the revised plans show an access easement across Parcel B and also an easement for power and a right of way to Parcel A.  He also noted that additional probes have also been completed to conform to the MABL requirements.  He also noted some additional spot elevations and grades have been shown on the plan for the extension of the driveway leading up to the existing house.   

Thompson reviewed the items outlined in Metcalf’s letter of May 12, 2011.  He also noted that Mr. Metcalf has not seen the revised plans that were submitted tonight.  Ross noted that the issue of open space had been addressed at the April meeting.  Thompson asked if the common driveway as specified by the IWWC had been shown on the plan.  Hendriks stated he has not done that on these plans.  He further stated it is really not Mr. Battalino’s wishes to have a common driveway, but if that is what is required then it will be added to the plan.  Thompson read into the record Item 3 in Attorney Cassella’s letter dated April 14, 2011 to the Planning Commission……Inland Wetlands Permit… The Inland Wetlands Commission approved the permit with the condition that the existing driveway be abandoned upon the development of Parcel B.  Under the wetlands permit, the existing driveway can remain until the new lot is developed, but the approval is based upon a common driveway providing access to Parcel B over Parcel A.  In approving this subdivision, the Commission should require that the plan be amended to reflect that the

existing driveway will be abandoned.  Further, the Commission should condition the approval on the review and approval of the common driveway easement by the commission’s counsel.  

Thompson noted that the drawings should reflect what the IWWC approved and if at some point in time the applicant so chooses he can go back to the IWWC with an application requesting to modify the plan that was approved by the IWWC.    

Thompson also reviewed the items outlined in Ann Brown’s letter to the commission.  It was determined all her concerns had been addressed with the exception of street addresses.  Hendriks indicated he would meet with the Town Assessor prior to filing the mylars but also noted that this was an illegal subdivision and the lot had already existed and therefore may already have an address.  

Hendriks stated that he will add a note to the plan relative to the abandonment of the driveway upon the development of the parcel.  

Ross stated he felt the commission could act on the application with the condition that the mylars not be signed until a review has been received by Tom Metcalf indicating all the conditions had been met.  McCarthy stated he felt Metcalf should review the revised plans prior to the commission taking any action.  Thompson concurred.   Ross stated he felt the revisions were minor and did not really change the character of the application.  McCarthy stated he felt it was just more of a procedural concern.  The applicant indicated he was fine with continuing this item until the June meeting.  

Harold Thompson made a motion to table any action until the June meeting in order to provide staff time to review the revised plans.  Steve Ross seconded the motion.  The motion passed unanimously.  

READING AND APPROVAL OF THE APRIL MINUTES

Steve Ross made a motion to waive the reading and approve the April Meeting Minutes as submitted.  Robert McCarthy seconded the motion.  The motion passed unanimously.
